This section describes the way our company deals with the penalties received by our customers during the rental period of the car.
Important changes from 2017
Since 1.01.2017 fines for violations of traffic regulations have been sent forward between EU countries and therefore the number of fines received has increased dramatically. So there has been a vivid need to write this material.
Penalty notice
Under European law such fines are to be paid by the driver who committed the violation and the owner of the vehicle is required to provide the police with personal data of the driver who committed the violation. Therefore, in case of receiving a fine we contact the Client who rented the car during the violation and send him the scan of the penalty. In case we cannot contact the Client or in the absence of payment of the fine from the Client in the specified time, we transfer the data about the Customer who committed the violation to the police. We would like to note that in case of failure to pay a fine in the prescribed time, a case is initiated on this violation and later the offender is charged with a fine much bigger than the original one. In the case of timely payment, the offender remains anonymous and further processing of the violation does not occur.
What determines the amount of the fine?
The amount of fines depends on the countries in which they were received, however, about 75-80% of the coming fines vary in the range of 40-100 euros. There were also cases when very large fines were received, for example the fine of 380 euros.
We would like to warn all speed-lovers: speeding is fixed by cameras, even if the excess was only 4 km/h, you will definitely receive a speeding fine. The amount of the fine in most countries is proportional to the excess: the higher the speed violation, the bigger is the penalty. In Central Europe the largest fines are in Italy, Switzerland and Hungary.
How to pay the fine?
The Customers who have received a fine after the trip can pay it themselves from an ordinary bank account at home. The main thing is to indicate the identification number of the fine so that it could be correctly identified in the police. After the payment of the penalty it is necessary to send a confirmation of payment to us by e-mail; In case of non-payment we MUST provide information about the driver to the police. Customers who do not want or cannot pay the fine themselves can use our help free of charge. In this case the Customer sends us the details of his card and the agreement to withhold the fine amount + EUR 10 for the SEPA transfer (bank transfer payment). Unlike many rental companies in Vienna, we do not charge an administrative fee for handling fines. After the payment of the fine we send the confirmation of the payment to the Customer. All the above information refers not only to violations of the speed limit but also to all other violations (parking, maneuvers, etc.). By the way, we have had an interesting case, when FOUR intraday fines were received from the Italian police for the wrong parking.
If the Customer was issued a fine in another country, it is better to pay it on the spot, in the same country in which it was received. The easiest way to do it is to pay at the Post office. In some cases, you can pay the fine in the Bank. It usually comes out more expensive to pay the fine from another country, even within the EU. It is recommended to keep fine payment confirmation for two years after payment. The Customer can transfer Austrian unpaid fines to our employee at the time of the car return along with the amount to pay fines and postage fee. Our employee will pay fines instead of the Customer free of charge.
Important note
In Austria and some other EU countries, there is a little-known law, noncompliance of which can lead to very high expenses (fine, evacuation, impound lot). If the car is not parked in a private garage or paid parking, but at the usual place where parking is not prohibited by traffic rules, each driver, is obliged to check the position of the car every three days. This is because the minimum period from which the temporary sign becomes valid is three days. In simple terms, a sign can be installed anywhere. For example, it can be a sign for no-parking zone. And after three days, when the sign starts to be valid, all cars standing under the sign can be evacuated to the impound lot, even if three days ago they did not violate anything.
